Terms of use.

1. What Munkoyo does

Munkoyo is a marketplace that connects buyers with independent sellers in Zambia. When you buy an item, the contract of sale is between you and the seller. Munkoyo provides the website, helps with payments and delivery arrangements, and steps in to help resolve problems as described in the returns policy.

2. Your account

• You must be 18 or over and give accurate details.
• Keep your password private. You are responsible for what happens in your account; tell us straight away if you think someone else has used it.
• One account is used for both buying and selling.
• We may suspend or close accounts that break these terms, act fraudulently or put other users at risk.

3. Buying

• Prices are set by sellers in Zambian kwacha (ZMW), and you pay in kwacha. Amounts shown in other currencies are only a guide.
• Delivery fees and times at checkout are estimates from delivery partners. The seller confirms availability and timing. Delivery outside Zambia needs a quote from the seller.
• Your order is a request to buy. It is confirmed when the seller accepts it. Sellers may decline an order, for example if an item has sold elsewhere; you won’t be charged for declined items.
• For mobile money confirmed with the seller, no payment is taken on the website: pay only using the instructions the seller gives you for that order, and keep your mobile-money reference. Unpaid orders expire after 24 hours and the items go back on sale.

4. Selling

New shops are reviewed before they go live. As a seller you agree to:

• sell only items you have the right to sell, described honestly with your own real photos;
• not sell counterfeit or replica goods, or items using another brand’s name or logo without permission;
• not sell illegal, stolen, dangerous or prohibited items, including weapons, drugs, alcohol or tobacco, live animals, or anything that needs a licence you don’t hold;
• keep prices and stock up to date, respond to buyers promptly, and dispatch accepted orders in the time you state;
• follow the returns policy and Zambian consumer law, and pay any taxes due on your sales;
• use buyers’ personal information only to complete their orders.

Munkoyo may hide or remove listings and suspend shops that break these rules. [Set out any commission or fees Munkoyo charges sellers, and how and when sellers are paid.]

5. Reviews and messages

Only buyers with a completed order can review an item. Reviews and messages must be honest and respectful, and must not include personal information, insults, spam or illegal content. We may hide or remove content that breaks these rules; anyone can report a review.

6. Content and photos

Sellers keep ownership of their photos and descriptions, and allow Munkoyo to show them on the marketplace and in our promotions. The Munkoyo name, logo and website design belong to [Registered company name].

7. Responsibility and liability

Sellers are responsible for the items they sell. We work to keep the marketplace safe and available, but we can’t promise it will always be free from errors or interruptions. Nothing in these terms limits rights you have under Zambian consumer law, or liability that can’t legally be limited. Otherwise, Munkoyo is not liable for indirect losses, and our liability for any order is limited to the amount you paid for it.

8. Changes, law and contact

We may update these terms; if a change matters, we’ll tell you before it applies. These terms are governed by the laws of the Republic of Zambia, and disputes are handled by the courts of Zambia, without affecting your right to complain to the Competition and Consumer Protection Commission.
